Mayer Brown adds prominent employment litigator
John Zaimes as a partner in Los Angeles

25 January 2012

Los Angeles, 25 January, 2012 – Mayer Brown, a leading global law firm, announced today that employment law litigator and advisor John Zaimes has joined the firm in Los Angeles as a partner in the Litigation & Dispute Resolution Practice.  Previously, he was a partner at Reed Smith in Los Angeles.

“California is a bastion of employment litigation, and John has established a reputation as one of the leading employment lawyers in the state,” said Phil Recht, partner-in-charge of Mayer Brown’s Los Angeles office. “With his proven track record for guiding clients through the intricacies of California employment law and defending them in a wide range of disputes, John significantly enhances our ability to serve the employment law needs of clients with current or planned operations here.”

Mr. Zaimes has extensive litigation and counseling experience in all types of employment-related issues, including wrongful termination, wage and hour, harassment and discrimination claims, as well as OSHA matters and reductions in force. He also frequently handles matters involving covenants not to compete, employee solicitation and the protection of trade secrets and confidential information. He regularly defends companies in class action suits, including those claiming violations of California’s wage and hour laws and those brought under the federal and state consumer credit reporting statutes.
“Mayer Brown is a great strategic and synergistic fit for my practice,” Mr. Zaimes said.  “Employment law in California presents many unique issues that my more than three decades of experience can help the firm’s clients manage successfully, while its global platform and deep capabilities in a broad range of legal specialties are resources I look forward to offering to clients I have represented previously. Other characteristics of the firm that attracted me are its collegial culture and its commitment to excellence in legal work and client service.”

Clients Mr. Zaimes has represented include manufacturers, credit and related reporting agencies, financial institutions, retailers, life sciences companies, consulting firms, hospitality and food service companies and sales organizations.  Representative matters he has handled include:

  • Harris v. Vector Marketing Corporation, in which he defended Vector in a class action alleging violations of the federal Fair Labor Standard Act and the California Labor Code. Mr. Zaimes defeated several attempts to expand the geographic and substantive scope of the case and succeeded in paring down the case through motions for summary adjudication and for judgment on the pleadings.  The parties later agreed to settle their dispute.
  • Perry, et al. v. The Vitamin Shoppe, one of three similar class actions in which the plaintiffs claimed The Vitamin Shoppe had misclassified store managers and failed to provide meal and rest periods. Mr. Zaimes brought one of the cases to early mediation, thereby foreclosing any recovery in the other two related cases. He also successfully fended off attempts by attorneys in those two cases to undo the settlement.
  • Diaz v. First Advantage Corporation, a class action that alleged violations by First Advantage of the California Investigative Consumer Reporting Agencies Act for failure to provide accurate pre-employment background checks. Mr. Zaimes prevailed on a motion to dismiss the key class action allegations, which led to resolution of the remaining individual claims through a favorable settlement.
  • Solar Turbines v. Division of Labor Standards and Enforcement, a declaratory relief suit against the State Labor Commissioner over interpretation of the alternative workweek provisions of California’s wage and hour laws. Following a bench trial, Mr. Zaimes prevailed on all counts.

Mr. Zaimes received a B.A. degree cum laude from the University of California, Los Angeles (UCLA), a M.A. degree from Northwestern University and a J.D. degree from Georgetown University Law Center.
