Mayer Brown litigators in Chicago persuaded the Illinois Appellate Court to order a new trial for our pro bono client, who was convicted of murder and attempted murder in 1996. The court found that our client’s trial attorney had a per se conflict of interest, rendering the convictions unconstitutional, because the attorney previously represented the murder victim and failed to disclose that conflict. The trial attorney also admittedly knew about our client’s alibi but failed to present the alibi to the jury or call any eyewitnesses to rebut the state’s evidence. The appellate decision followed a post-conviction evidentiary hearing in which we presented evidence concerning the per se conflict and ineffective assistance of counsel claims. The team was led by partner Lori Lightfoot and senior associate Chad Clamage, who handled the briefing at all stages, and included associates Rebecca Klein, Mike Morrill, Chris Ferro and Jed Glickstein.
