Gabriela Kennedy delivered a seminar on “Licensing Models for Digital Rights” to Hong Kong Science & Technology Parks Corporation (HKSTP) on 15 March 2016 at the Science Park, Shatin. Gabriela explained the different treatment of IP rights in the hard-copy vs online world, looked at different models for the distribution of IP rights online and case law on digital exhaustion of rights in the EU and the US.
Gabriela looked at a possible model for a Digital First Sale Doctrine and its concerns including the removal of control over digital content and the effect on price discrimination. She also covered the do’s and don’ts for digital content distributors, the challenges faced by them and provided some solutions and workarounds to overcome legal pitfalls. Gabriela concluded the seminar with some key takeaways and a Q&A session.
