New Illinois Legislation Impacts Employers’ Use of Non-Compete and Non-Solicit Covenants

The Illinois General Assembly recently passed a bill that significantly impacts the enforcement of non-compete and non-solicit covenants for employees in Illinois. Governor JB Pritzker is expected to sign the bill into law shortly. Accordingly, as we explained in a Legal Update earlier this week, employers should review their existing restrictive covenant agreements, determine whether to enter into new agreements (or amend existing ones) before the law takes effect and take steps to ensure that their future agreements satisfy new enforceability requirements.
