Bank Partnerships, Madden and True Lender Developments

Share

Join us for our new series, Coffee Klatch, where we will discuss issues confronting the consumer financial services industry. This 30-minute series will offer 20 minutes of discussion on a key topic and 10 minutes of interactive Q&A.

In 2020, there have been a number of significant legal developments related to Madden and true lender, including agency rulemakings, lawsuits and the settlement of litigation in Colorado. The lawsuits challenging the Office of the Comptroller of the Currency (OCC) and US Federal Deposit Insurance Corporation (FDIC) rules and other possible state regulatory or enforcement actions will have a direct impact on bank partner programs, platforms, investors and secondary market participants and will likely shape the debate around these issues for the foreseeable future.

Join members of Mayer Brown’s Consumer Financial Services practice as they discuss recent legal and regulatory developments important to participants engaged in financing, purchasing or investing in consumer and small business credit, including:

  • What to expect in 2021
  • Litigation related to OCC and FDIC “valid when made” rules and the potential implications for secondary market purchasers
  • OCC “True Lender” rule update
  • State attempts to restrict usury rates
