Equality of Parties before International Investment Tribunals

On 10 February 2021, William Ahern and Alina Leoveanu from Mayer Brown Paris hosted and moderated the ICC YAF on the topic of Equality of Parties before International Investment Tribunals.

The topic was the subject of a study and 2019 Resolution of the Institut de Droit International. After the keynote address delivered by Toby Landau QC, the panel discussed issues covered by the study and Resolution, including the effect of the State’s criminal law powers on the tribunal’s process, States’ rights to institute counterclaims and equality of parties in the composition of international investment tribunals.
