As a result of the passage of the 2017 Tax Cut and Jobs Act (“TCJA”), tools and techniques of statutory construction might soon become more significant in tax disputes. Under the accustomed tools of statutory construction, the TCJA can present significant challenges both for taxpayers who seek to interpret the statute and those who become entangled in controversy with the IRS.
