State Law Developments in Cybersecurity and Data Privacy

In the United States, a patchwork of varying state laws continue to regulate cybersecurity and data privacy. Now that all 50 states have data breach notification laws, the focus of state legislatures and regulatory authorities has expanded to encompass new aspects of cybersecurity and data privacy. In many cases, cybersecurity mitigations that were once simply best practices are increasingly legal or regulatory requirements. For example, recent legal developments relating to cybersecurity at the state level have included requiring companies to implement specific types of measures to protect personal information and establishing regulations specific to the Internet of Things.

In addition, following the enactment of the California Consumer Privacy Act (CCPA), numerous states have also proposed similar laws relating to consumer privacy rights, and a new ballot initiative in California aims to expand the requirements further.
