Impact of the Supreme Court's "Honest Services" Ruling

Today the US Supreme Court issued opinions in three cases closely watched by the business community: Skilling v. United States (08-1394), Black v. United States (08-876), and Weyhrauch v. United States (08-1196). The Court held the "honest services" criminal statute - which provides that the federal mail and wire fraud offenses encompass "a scheme or artifice to deprive another of the intangible right of honest services" - encompasses only bribery and kickback schemes. This narrowing of the fraud statute could impact future prosecutions.
