Warsha Kalé is counsel in Mayer Brown's London office and a member of the Antitrust & Competition group. She has over 18 years' experience of advising private and public sector bodies in relation to EU and competition law, and public/utilities procurement.

Warsha advises clients in a wide range of sectors on the application of UK and EU competition law including: acting for clients in cartel investigations, advising on UK Competition Act investigations, and advising on the application of the UK merger regime and the EU Merger Regulation. In particular, she advises multinational companies on multijurisdictional merger control.

Prior to joining Mayer Brown in 2015, Warsha practised at a top international law firm where she was seconded to an Indian firm for four months.

Abuse of dominance

  • Advising a technology company in respect of written and oral representations to multiple competition authorities concerning alleged exclusionary conduct by a global semiconductor manufacturer. 

Multi-jurisdictional merger control

  • Advised a global bank on the merger control aspects of a USD 33bn acquisition
  • Advised a Chinese telecoms company on the merger control aspects of an acquisition in Europe


  • Advising a freight forwarder on the global cartel investigations into freight forwarding, including working closely with local counsel in respect of investigations in non-EU jurisdictions.
  • Advising a car parts manufacturer on the global investigations into automotive wiring harnesses.

EU merger control

  • Advised an international nickel producer on the European Commission’s in-depth investigation into its USD 19bn proposed takeover of a rival producer.
  • Advised a real estate fund on its EU merger notification in respect of the creation of a potentially full function joint venture.

UK merger control

  • Advised a major retailer on the Competition Commission’s in-depth investigation of its acquisition in the sports retail sector; the acquisition was cleared unconditionally.

Market investigations

  • Advised an audit firm as a main party in the Competition Commission investigation into the statutory audit of FTSE 350 companies.
  • Advising an investment consultant in respect of the in-depth investigation by the Competition and Markets Authority (CMA) into investment consultancy/fiduciary management.

UK Competition Act

  • Advised a potential complainant to the CMA in respect of possible anti-competitive activity in the leisure industry.
  • Advised the Office of Rail Regulation in respect of a complaint made to it, including advice on whether it should give interim measures.

Public procurement

  • Advised public body on its £5bn procurement of a Collaborative Delivery Framework, as well as compliance with competition rules on information exchange and amending its current contracts in order to comply with the new EU Directive.
  • Advised AG Quidnet on its procurement and EU Treaty claim in the Technology and Construction Court against the London Borough of Hounslow regarding the proposed redevelopment of Hounslow Town Centre, heard in an expedited trial in July 2012 (one of the leading 2010 cases on EU Treaty principles).  

Utilities procurement

  • Advised a major utility on a number of major procurement matters: in particular, its procurement of partners for an infrastructure alliance for its AMP6 investment programme for 2015-20 (with extension options running into the AMP7 and AMP8 periods).

Sectoral regulation

  • Advised a major utility on an investigation by Ofwat into sewage flooding reporting under section 203 of the Water Industry Act.
