Financial Services Regulatory & Enforcement leader Jeffrey Taft (Washington DC) will moderate a panel on bank insolvencies. The recent failure of several large regional banks was a good reminder that bank insolvencies are radically different from corporate bankruptcies in procedure and substance. These differences have practical ramifications for pre-insolvency contract negotiations and post-insolvency resolution actions. Further, the FDIC’s “superpowers” and claims process can result in surprisingly punitive outcomes for many creditors and other counterparties. His panel will discuss these considerations from an action-oriented perspective of how practitioners and their clients can prepare for the next crisis.
