In a recent employees' compensation appeal case of Wan Jingyi v. Hoo Chun Wing T/A Kai Chun Good Well & Ors. (CACV 105/2016), Hong Kong's Court of Appeal has unanimously upheld the lower Court's decision to dismiss an applicant's employees' compensation claim. The Court of Appeal's decision reinforces the legal principle that in employees' compensation cases, an applicant bears the burden of proof to show that an accident had happened in the course of, and arising out of his/her employment.

On 31 January 2017, Rules 2017 (the "2017 Rules") of the Thai Arbitration Institute ("TAI") came into force, introducing much needed changes to the way arbitrations will be conducted in Thailand. By replacing the 2003 Rules, the 2017 Rules aim to improve the efficiency and predictability of TAI administered arbitrations. Implementation of the new rules should be welcomed by users of arbitration in Thailand since the 2017 Rules seek to address certain procedural lacunae which were often abused (or taken advantage of) by recalcitrant parties. The 2017 Rules will apply by default, unless otherwise agreed by the parties, to all arbitrations commenced under the TAI's auspices after 31 January 2017.

Mayer Brown JSM announced today that Yu-Jin Tay is joining the firm as a Singapore-based partner in its International Arbitration group. Mr. Tay joins with two arbitration associates who focus on international arbitration and was formerly at DLA Piper, where he served as co-chair of that firm’s international arbitration group from 2013 to 2016. Before 2013, Mr. Tay was the Singapore-based head of Shearman & Sterling’s international arbitration practice in Asia.
