On Monday 1 August 2016 the EU-US Privacy Shield regime 'went live', replacing the Safe Harbour regime (which had been declared invalid by the European Court of Justice). Under the Privacy Shield regime personal data can be transferred from member states of the EU and the European Economic Area to specific entities in the United States which can certify themselves compliant with the Privacy Shield Principles. However as we explain below this will have little, if any, impact on financial institutions faced with requests to transfer data from the EU to the US in connection with US litigation.

The European Commission adopted a proposal on 5 July 2016 that brings in new controversial measures to amend the Fourth Anti-Money Laundering Directive, (“4MLD”) not least bringing the proposed transposition date forward to the end of 2016. 4MLD was adopted on 20 May 2015 as part of EU efforts to combat the laundering of money from criminal activities and to prevent the financing of terrorist activities, in recognition of the fact that funds can be hidden and moved across the world with increasing ease.

On 20 July 2016, a nine member panel of the Supreme Court handed down its judgment in Willers v Joyce and Anor (in substitution for and in their capacity as executors of Albert Gubay (deceased)), in which it decided by a 5:4 majority that a claim for malicious prosecution of civil proceedings is sustainable in English law – extending the tort beyond its traditional boundaries of the malicious prosecution of criminal claims or the use of ex parte coercive measures.
