The Supreme Court and Business: Looking Ahead to the 2008 Term

A ruling in one of the most notable cases currently before the Supreme Court, Wyeth v. Levine, could send shockwaves through the tort system by offering companies virtually impenetrable product-liability shields. Join us for a web conference hosted by Mayer Brown LLP and Incisive Media (formerly American Lawyer Media) that will examine this and other high-profile business cases in the upcoming Supreme Court Term.

Andrew Pincus, former Assistant to the Solicitor General and former General Counsel of Andersen Worldwide S.C., and Dan Himmelfarb, former Assistant to the Solicitor General, will discuss Wyeth v. Levine along with other business cases on the Court's docket, including:

  • Pacific Bell Telephone Co., dba AT&T California v. linkLine Communications, which addresses the circumstances under which a "price squeeze" claim can be brought under the antitrust laws
  • Crawford v. Metropolitan Government of Nashville, which addresses whether Title VII protects employees from being fired for cooperating with an employer's internal investigation
  • 14 Penn Plaza LLC v. Pyett, which addresses the enforceability of an arbitration clause in a collective-bargaining agreement waiving employees' right to file statutory discrimination claims
  • Entergy Corp. v. EPA, which addresses whether the Clean Water Act authorizes the EPA to employ a cost-benefit analysis in determining the best technology available to reduce the environmental impact of cooling-water intake structures
  • FCC v. Fox Television Stations, which addresses a challenge to the FCC's policy on "fleeting expletives" on broadcast television.
