Although the United States is the jurisdiction with the most private antitrust litigation, recent developments in the member states of the European Union have demonstrated that claims for private enforcement of antitrust laws are increasing. Please join us for a lively session where we will discuss the current state of private antitrust litigation and our opinions on the future of enforcement in these jurisdictions.

Specific topics of discussion include, amongst others:

  • The impact and application of recent US Supreme Court rulings, including Twombly, Credit Suisse, and Leegin.
  • The role of the Antitrust Criminal Penalty Enhancements and Reform Act in US civil litigation.
  • The new European Commission white paper on private litigation - where is the EU heading?
  • The increase in third party funding and consumer class actions in the EU member states.
