During its 2007 Term, the US Supreme Court heard case after case with far-reaching implications for the business community. From the appeal described by the Wall Street Journal as "the biggest securities-litigation court clash in a generation," Stoneridge Inv. v. Scientific Atlanta, to the case that has potential to recast legal standards governing punitive damage awards in tort litigation, Exxon Shipping Co. v. Baker, the Court's decisions this Term and what it will hear next Term are of great importance to businesses and their counsel.

Mayer Brown invites you to join us for a peer-to-peer discussion on recent decisions from the 2007 Term and the certiorari petitions already granted for the 2008 Term. Topics to be discussed include:

  • The increase in the number of federal preemption cases and their impact on business.
  • The effect Exxon might have on other punitive damages cases.
  • Stoneridge and the Court's approach to civil liabilities under the securities laws.
  • The Court's reaction to the increased use of arbitration to settle business disputes.
  • Employment and ERISA litigation pending before the Court.
