Stock Drop Litigation: Recent Developments and Emerging Trends

As the global financial crisis affects markets and stock values, we expect to see a dramatic increase in so-called "stock drop litigation" in the coming months. These ERISA claims, which often allege breach of fiduciary duty against plan administrators, the company and its directors, are frequently preceded by securities claims, and can be very attractive to the plaintiffs' bar.
