Medical Monitoring Claims—Trends and Defenses

The plaintiffs’ bar has increasingly relied on medical monitoring claims to support class action suits on behalf of individuals who have been exposed to allegedly harmful products but who have not incurred physical injuries. While many courts have rejected such claims, others have adopted and applied them in a variety of different contexts.
