Managing Electronic Data in FCPA Investigations

In this luncheon presentation for Washington-area executives and corporate counsel, lawyers from Mayer Brown LLP, joined by e-discovery professionals and lawyers from ePIC Legal Document Solutions LLC and Catalyst Repository Systems, will address legal and technical challenges encountered in international FCPA investigations. The panelists will describe the following challenges and discuss best practices for addressing them so as to minimize risk, cost and delay:

  • Privacy and Data Protection Laws. Panel members will review restrictions - such as the European data protection regime - on the processing and transfer of overseas data for purposes of U.S. litigation, and strategies for minimizing the risk of violating foreign law.

  • Language. Panel members will address challenges presented by foreign-language data, and technological strategies for timely and cost-effective collection and processing of this data, including a review of some of the latest services and technologies for data filtering and translation.

  • Time Zones. Panel members will discuss date normalization issues associated with data from multiple time zones, and strategies for avoiding confusion.
