IN FOCUS - Get Ready: A Comprehensive Approach to Antitrust Investigation

What do you do when the DOJ's Antitrust Division comes knocking, subpoena in hand? As the Assistant Attorney General promises increased vigilance in the civil and criminal enforcement of antitrust laws, companies should be prepared to move quickly if they become the target of an investigation. Company lawyers must proceed with calm resolve, taking the necessary steps to ensure that all compliance obligations are met; that all stakeholders are fully informed; and that the relevant facts are gathered and assessed. They must manage the government, and keep potential civil plaintiffs at bay. And they must do all of this quickly.

The discussion focused on:

  • Internal management, including investigation, communication, preservation and reporting
  • Regulatory management, including best practices in working with government enforcers
  • External management, including strategies for controlling civil litigation and limiting liability
