The law governing the enforceability of arbitration agreements continues to evolve. As both courts and Congress examine arbitration agreements more closely, it has become increasingly important to ensure that arbitration provisions are drafted carefully and that consumers and employees are provided with fair procedures for pursuing their disputes. Businesses should pay close attention to both the Supreme Court's continued interest in the Federal Arbitration Act and the legislative proposals now making their way through Congress.
