Class Action Litigation in Federal Court After Shady Grove

Last week, the US Supreme Court handed down its much-anticipated decision in Shady Grove Orthopedic Associates v. Allstate Insurance Co. In a 5-4 decision that involved multiple opinions, the Court held that a class action could go forward in federal court under Rule 23 of the Federal Rules of Civil Procedure despite the fact that the state statute on which the claims were based expressly precludes class actions.
