Mayer Brown partners John Mancini and Carmine Zarlenga named 2020 “Litigation Trailblazers” by NLJ

Mayer Brown announced that Intellectual Property partner John Mancini (New York) and Litigation & Dispute Resolution partner Carmine Zarlenga (Washington DC) have been named to The National Law Journal’s (NLJ) list of “Litigation Trailblazers.” The annual list recognizes litigators from across the nation who are agents of change and have taken extra measures to contribute to positive outcomes. Mr. Mancini and Mr. Zarlenga were recognized for representing 3M in a first-of-its-kind suit against price-gougers after Performance Supply LLC, which falsely claimed to be affiliated with 3M, raised the price of 3M-branded N95 masks to 500% over the list price in offers to New York City public health procurement officers. “We were the first to file, and the first to get an injunction, which was then replicated by numerous other law firms acting on behalf of 3M,” Mr. Zarlenga said.

They relied on a novel approach involving the Lanham Act, which prohibits trademark infringement, trademark dilution and false advertising. “The classic Lanham Act case involves products that confuse consumers as to their source... But in this instance, it was about a false affiliation with 3M, and that’s what got us the injunction,” Mr. Mancini told NLJ.
