Today USCIS announced that it will temporarily suspend premium processing for H-1B FY2019 cap-subject petitions received by its Service Centers as of Monday, April 2, 2018. Accordingly, as of April 2, USCIS will reject any Form I-907, “Request for Premium Processing Service” filed with an FY2019 cap-subject H-1B petition. The announcement indicates the suspension is expected to last until September 10, 2018.
Last year, USCIS made a similar announcement in March 2017 regarding the suspension of premium processing. That suspension was broader in scope, affecting all H-1B petitions including cap-exempt petitions such as requests for extension of status. Based on today’s announcement, this year’s suspension is limited to cap-subject petitions only.
During the suspension of premium processing, petitioners may request expedited processing if they meet certain expedite criteria. USCIS will review expedite requests on a case-by-case basis, and requests will be granted at the discretion of USCIS office leadership.
