An adverse costs order is but one of the risks parties to litigation run. That risk, in recent years, has increasingly extended to non-parties, based upon the court’s jurisdiction to award costs against non-parties set out in section 51(1) and (3) of the Senior Courts Act 1981, albeit such orders are “exceptional”.
