In April 2015, the U.S. Department of Labor re-proposed a regulation defining who is considered a “fiduciary” of an employee benefit plan under the Employee Retirement Income Security Act of 1975 (“ERISA”), with respect to investment advice or recommendations provided to a plan or its participants or beneficiaries.
