A subject for debate arising out of the financial crises is regulatory failure. This author suggests that competition compliance will be affected by that debate in relation to: who has ownership within a corporation for the compliance programme; ensuring the programme is always up-to-date with both the changes in the businesses of the corporation and the foci of the competition authorities; and recognising the tougher stance that competition authorities are likely to adopt.
