Summary
Friday 13 July will be the day on which the new provisions concerning calculation of certain statutory benefits will come into force. This gives employers less than 2 months to revise their payroll systems. JSM has prepared a note to assist employers in this process.
Full Update
We have prepared a note on the implications of the Employment (Amendment) Ordinance 2007. This is available from the following link:
JSM Note on Employment (Amendment) Ordinance 2007
There are a number of questions which remain unanswered. These include:
- what happens when an employee moves from full time to part time, or vice versa (or otherwise changes his or her working hours)?
- where an employee is paid monthly how do you calculate whether an employee receives his or her "full wages" for a day of leave?
No doubt these questions (and plenty more) will be decided by the courts in due course.
