When the Supreme Court handed down its most recent decision on punitive damages, Philip Morris USA v. Williams, 127 S. Ct. 1057 (2007), this February, many commentators (and, perhaps not coincidentally, many plaintiffs’ lawyers) downplayed its significance because the Court did not address whether the $79.5 million punitive award against Philip Morris was unconstitutionally excessive.
