Nick’s review looks at three recent cases in the Employment Appeal Tribunal. The first looks at the test for whether adverse treatment is “arising” from disability. The second considers whether an employee could prevent an employer using material given to it by a third party which had been taken from the employee’s mobile phone. The final case considers whether a belief that the public sector is wastes money could be a philosophical belief covered by the Equality Act 2010.
