In addition to state-level licensing requirements that apply to originators and servicers of consumer and small business loans, many states require the owner of such loans to be licensed. Similar requirements may apply to the owners of servicing rights. We will outline the various licensing requirements applicable to acquiring, holding and servicing consumer and small business loans and discuss various trust structures that may facilitate engaging in such activities without obtaining such licenses. We will also discuss some of the advantages and disadvantages of using such structures in lieu of obtaining and maintaining such licenses.
