On 24 September, Mayer Brown’s London office hosted a transactional liability insurance roundtable for members of the transactional liability insurance ecosystem. The seminar was a substantive discussion on the rapidly expanding and evolving UK market for transactional liability insurance, with a particular focus on warranty and indemnity insurance (W&I). Our event was designed for industry professionals and focused on trends, issues and challenges faced by underwriters, claims teams, brokers and other participants in the W&I ecosystem. While the focus of the roundtable was on the UK market, we also had panel participants from the US commenting on trends and issues that are “spilling across the pond”.

The program included M&A practitioners who regularly represent both underwriters and insureds in underwriting and procuring these insurance products, as well as litigators who are highly experienced in transactional insurance claims. Corporate & Securities partners Beccy Bothamley (London), James West (London), Joe Castelluccio (NY) and Bill Kucera (Chicago), Litigation & Dispute Resolution partners Jane Childs (London) and Bob Harrell (Houston) and senior associate Matthew Knight-Olsen (London), and Tax senior associate Kitty Swanson (London) shared insights on key topics in the industry, including substance and process issues in the underwriting process, damages and valuations issues that frequently arise in claims, and developments in the US market with potential impact on UK policies. The Mayer Brown team was also joined by Geoff Mesher, a Managing Partner at Tempest Forensic Accounting UK LLP.
