On June 29, EU lawmakers approved the text of a new European regulatory framework for securitisation transactions to be adopted by early 2018 and become applicable from January 2019. This legislative package, developed and negotiated over several years, includes a new Securitisation Regulation and amendments to the bank capital requirements for securitisation. The Securitisation Regulation sets out new or recast rules on investor due diligence, originator or sponsor risk retention, and disclosure and reporting requirements, as well as criteria and processes for so-called ”simple, transparent and standardised” (”STS”) securitisations that will have lower capital requirements and perhaps other regulatory benefits.
