In recent years, European banks have had to pay out or set aside considerable amounts related to legal and regulatory risks. In particular, European banks have been heavily hit by enforcement actions of US bank regulators. While some major cases were recently settled, such settlements, along with new issues that are always emerging, frequently serve as the stage for another round of US enforcement actions. At the same time, in the UK and Hong Kong, regulators also use enforcement actions and fines increasingly as an important “supervisory tool”.

Our speakers will examine recent developments in enforcement actions and investigations in the US, Europe and Asia with relevance for German banks with a view to enabling banks to minimise the risk of being involved in the next round of enforcement actions. Topics will also include complex issues of privilege, law enforcement attitudes to internal investigations, managing monitors and the many challenges financial institutions face when handling multi-national parallel investigations and litigation.
