A cross -border and cross-practice team of Mayer Brown lawyers comprising of Gabriela Kennedy (IP and TMT, Hong Kong) , Gary Hnath (IP, Washington DC) , Henry Wang (Corporate, Beijing) and Xiaoyan Zhang (IP and TMT, Hong Kong) delivered a seminar organised by China Technology Exchange Limited (CTEX) on 22 September 2015 in Beijing.
The seminar, titled “Demystifying Patent Litigation in the US and Cross-Border Technology Transfer: What Every Chinese Company Should Know”, attracted approximately 30 participants from a wide range of companies and organisations in the technology industry, including JD.com, Datang Telecom and CPI Corp., to name just a few. Yicheng Du, Chief Patent Officer of BMC Medical Co. Ltd., a client for whom the firm handled Section 337 patent litigation in the US also participated in the seminar.
Designed as an interactive panel discussion, the seminar began with a comparative study of the patent litigation systems in China and the U.S., during which Xiaoyan covered the differences and commonalities in patent activities and patent litigation in the two jurisdictions. Gary then provided an in-depth discussion of key strategies for Chinese companies litigating patent infringement cases in the U.S., which he illustrated through various case studies. The seminar continued with an interactive panel discussion where Gary and Xiaoyan were joined by Henry and Yicheng, who provided insights into how Chinese companies can work effectively with experienced lawyers to safeguard their legal rights when facing legal action in the US. Gabriela then took the stage to discuss common IP issues in cross-border technology licensing and transfer and the strategies to address them.
