On May 18, the Supreme Court issued its opinion in Tibble v. Edison International dealing with the duty of retirement plan trustees to prudently manage assets of the plan. Although the Court vacated and remanded the case for further consideration by the Ninth Circuit Court, the decision contains some valuable insight into the Court’s perception about a fiduciary “duty to monitor” investments under an ERISA plan.
