Events in the past year have shown that energy companies in the US and EU face a variety of antitrust risks from both government and private enforcement. Claims against industry participants have ranged from conspiracy and manipulation regarding oil prices to conspiracies to fix prices for hydraulic fracking services and to limit the availability of renewable fuels. In Europe, investigations into abuse of dominance and restrictive agreements have resulted in high fines and numerous settlements, which, in turn, have led either to the divestiture of networks and power plants or to behavioral restrictions such as capacity releases. This program will review the antitrust risks reflected by these investigations and cases and will provide pointers on how your company can limit such risks while engaging in legitimate business activities.
