The CFTC and the SEC have adopted rules that broadly define swaps and commodity pools and provide a non-exclusive but limited Insurance Safe Harbor. On October 10, 2012, the CFTC offered limited interpretive guidance for certain types of securitization vehicles, and on October 12, the rules became effective.
