One year ago, the US Supreme Court ruled in Concepcion that states cannot prohibit contractual clauses which require arbitration to be done on an individual (not class-wide) basis. Since then, efforts have intensified in courts, at federal agencies, and other forums to circumvent Concepcion. Our speakers will address those efforts, and discuss best practices that companies have used to conform their arbitration policies to Concepcion.
