The long-awaited Guidance for the implementation of the UK Bribery Act was issued by the Ministry of Justice on 30 March, along with Joint Prosecution Guidance issued by the Director of the Serious Fraud Office and the Director of Public Prosecutions. It was announced yesterday that the Act would become operative from 1 July 2011. The two documents (collectively, "the Guidance") provide in some respects a strikingly different interpretation of the United Kingdom's expansive new anti-corruption law from the interpretation that the authorities provided when the law was first enacted last year. Because the Act could apply to a company's activities anywhere in the world based on that company's nexus with the United Kingdom, all companies with business dealings in the United Kingdom need to be informed about the Act and the Guidance.
