2010 will be a momentous year in global derivatives and banking regulation. Some applaud this, blaming derivatives and lax banking controls for contributing to, or even causing, the financial crisis. Others point to a track record of heavy-handed and ill-considered regulation achieving nothing other than hampering the financial markets.
The over-the-counter derivatives markets have received unprecedented criticism since the start of the financial crisis. Reforms are quickly progressing with legislative proposals being made in the United States and Europe. There is uncertainty in the market as to what the future will hold. Central clearing platforms are being established and the industry is working with lawmakers to come up with solutions to some of the identified problems.
Ed Parker, Partner and head of the Derivatives Practice Group at Mayer Brown, will chair a panel including Dr Jean Pierre Zigrand, derivatives lecturer at the London School of Economics, Snigdha Singh, rates trader at HSBC, Martin Gudgeon, senior managing director of restructuring at the Blackstone Group, and Kirsty Devonport from ISDA, which will debate the following topics:
- the true role of derivatives in the recent financial crisis;
- current hot topics in the litigation arena involving derivatives and defaults during the crisis;
- lessons learned from the crisis: restructuring and alternative solutions;
- the direction and quality of future reform, including a discussion of US and European regulatory reform;
- un-tackled and remaining systemic risks; and
- the future of derivatives.
