This half-day, CPD accredited conference in association with the CIA is aimed at providing in-house lawyers and business executives at all levels within the chemical and related sectors with a relevant and practical understanding of the issues affecting the chemicals industry. The speakers will use case studies and practical examples to illustrate the issues and to highlight lessons that can be drawn from them.

Refinancing in the chemicals sector - current issues and innovative solutions
Refinancing debt has been one of the major issues affecting all companies in the chemicals sector this year. As the recession "is over" according to some sources, will high debt prices and stringent lending criteria continue? The seminar discusses the key issues and new developments (including pensions matters). The audience will also take part in a case study.

REACH - update and focus on REACH enforcement
This topic will discuss current developments in REACH legislation and will in particular focus on the REACH enforcement activities in the Member States and how companies can prepare for REACH inspections.

Rebates in Antitrust
Rebates have never been off DG COMP's radar screen, but they are certainly centre stage given the Commission's guidance on enforcement priorities (February 2009) on certain types of abuses, including rebates, and the Intel decision in April 2009, by which Intel was fined 1.06 billion Euros for its unlawful rebates scheme. The challenge for a company that is or might be in a dominant position is to determine whether or not its rebates scheme is lawful. This session will describe the methodologies DG COMP and other competition authorities are using, and give insights as to how they can be applied in practice.

The impact of the frozen finance markets, the upcoming closure of a significant chunk of generating capacity and the Government's ambitious green targets, all present significant challenges in the context of providing secure and affordable energy to the business community in general and the chemicals sector in particular. In this session we take a look at the main legal and policy initiatives aimed at upgrading the UK's energy infrastructure, the current state of the energy market and rate of investment as well as the prospects for achieving the goals the Government has set.

A chaired panel will discuss some of the day's key issues and answer the audience's questions.
