Antitrust is Back--Buckle Up for Aggressive Global Enforcement!

While antitrust enforcement has been fairly dormant in the U.S. under the laissez-faire approach of the Bush Administration, change, as we know, has come to Washington. Under the Obama Administration, the sleeping giant which has, in the past, led the world in antitrust enforcement has reawakened to try to reassume its center-stage role as an aggressive enforcer at an uncertain economic time around the world. In doing so, it faces an aggressive European Commission enforcement authority which has been the most active enforcer during the past eight years.

Similarly, the Chinese government has issued new anti-monopoly regulations, also inspired by the European approach. Worrying about antitrust suits has not been high on the list of most business concerns in recent years, but it's time to take note. This could be the biggest business policy threat of 2010... and it's global.
