Under the Foreign Corrupt Practices Act ("FCPA"), global companies are facing increased scrutiny from US civil and criminal enforcement officials and the real prospect of disgorgement, severe monetary penalties, and compliance monitors. At the same time, there is a trend towards increased cooperation between US enforcement officials and their overseas counterparts to pursue parallel investigations.
