Whether an investigation is initiated internally by a company to ensure compliance with federal or state securities statutes or regulations, to investigate possible violations of internal corporate policy as part of routine business practices, or in response to the government targeting the company for an investigation, corporate decision makers are likely to encounter numerous employment law issues before, during, and after the investigation. If these issues are not handled appropriately, and directed by and in compliance with thorough, well-drafted internal policies, the company and its management may find themselves defending against civil or even criminal charges. Further, having a command of these employment law issues will enhance the efficacy of the investigation and the corporate decision-making process.
