The right to agree to arbitrate disputes is under attack in New Jersey. Although protected by federal law, legislators and state court judges are persistently seeking end-runs around these federal contract protections.

Does the New Jersey legislature have the authority to restrict the use of arbitration or to deny opportunities to businesses who use arbitration? Is our state court arbitration doctrine consistent with federal law – or do those courts hold arbitration to a higher standard than other contractual agreements?
