Dawn-raids in the EU and US antitrust enforcement practice

The European Commission’s Directorate General for Competition has recently imposed hefty fines on several companies for procedural failures relating to dawn-raids in antitrust investigations. This practice has gotten the attention of antitrust practitioners and the corporate world. Yet, there is little Commission guidance and the topic is not covered in the Commission’s manual of procedures. In the US, the government may arrive unexpectedly to execute a search warrant or question individuals in criminal antitrust investigations against individuals, and the Department of Justice’s Antitrust Division has been very aggressive in gathering evidence under these circumstances. The two regimes share some similarities, but also involve important distinctions.
