US Bilateral Investment Treaties: Recent Developments

The United States is currently party to 48 Bilateral Investment Treaties (BITs), including seven that have been signed but not yet ratified. Several developments have recently occurred on the US BIT scene, which are notable as much for the discussion and debate they have produced as for the fact that they lie at very different ends of the spectrum in their promotion of US BIT interests. We review BITs, in general, the status of BIT discussions with the BRIC nations, the new US Model BIT and the prospective effect of Bolivia’s recent decision to terminate its BIT with the United States.
