US – Vietnam’s deal on shrimps would not put an end to trade disputes

Global Trade associate Hai Nguyen shares his views with The Saigon Times on the recently inked agreement between the United States and Vietnam to implement the WTO’s rulings on two longstanding disputes over imports of shrimp from Vietnam to the United States. Hai notes that the WTO victory and the voluntary enforcement by the United States would offer the Vietnamese Government confidence when resorting to legal means to protect its industries’ interest in the future. He however disagrees with the emerging view within local business that this agreement would help eliminate antidumping actions altogether. Hai emphasises that even the battle on zeroing (the most notable victory for Vietnam) has not yet ended, since the United States’ move to the so-called ‘Differential Pricing Methodology’ that has allowed the use of zeroing in certain circumstances over the past few years. This new method has also been ruled by the WTO’s Panel as inconsistent with the WTO rules. The dispute over this method is however being appealed to the WTO’s Appellate Body and we await to see whether the Appellate Body uphold the Panel’s rulings.
