Trade Defense Instruments: Analysis of the Negotiated Proposal on Modernization

Trade defense instruments ("TDIs"), including those for anti-dumping and anti-subsidy, aim to tackle unfair commercial practices caused by imports from third countries that are not part of the European Union that have an injurious effect on the state of the EU industry. The European Commission, the European Parliament and the Council reached a provisional agreement on a proposal to modernize the TDIs (the "Negotiated Proposal"), which was finally made available on January 23, 2018. This Legal Update discusses the Negotiated Proposal, the first major amendment of the European Union's trade defense legislation since 1995.
