Class Actions in the Supreme Court in the 2012 Term

Now that the US Supreme Court’s 2012 Term is coming to an end, we can begin to assess the impact of this Term’s decisions. The Court already has rendered decisions on a variety of issues of critical importance to businesses—with more to come—on topics such as antitrust, patents, preemption, environmental law, class actions, and securities.

Please join us for two webinars in which partners in Mayer Brown’s Supreme Court & Appellate and Consumer Litigation & Class Action practices will provide a recap of the 2012 Term and a preview of the key cases that the Court will hear in the 2013 Term.

On June 27, Andy Pincus and Dan Himmelfarb will discuss:

  • The most important business decisions from the Court’s 2012 Term, including those on the patentability of human genes (Association for Molecular Pathology v. Myriad Genetics, Inc.), the lawfulness of so-called “reverse payment” settlements (FTC v. Actavis), the enforceability of class waivers in arbitration clauses (American Express Co. v. Italian Color Restaurants), limitations on class actions (such as Comcast Corp. v. Behrend), and the reach of the Alien Tort Statute (Kiobel v. Royal Dutch Petroleum).
  • Business cases that already are on the docket for the 2013 Term.
  • The headline-making decisions regarding marriage and civil rights.

On July 2, Evan Tager, Archis Parasharami, and Kevin Ranlett will provide a more detailed review of the Court’s class action decisions:

  • The meaning and potential ramifications of the 2012 Term’s class action cases, including Comcast Corp. v. Behrend, Standard Fire Insurance Co. v. Knowles, Genesis Healthcare Corp. v. Symczyk, Amgen Inc. v. Connecticut Retirement Plans and Trust Fund, American Express Co. v. Italian Color Restaurants, and Oxford Health Plans LLC v. Sutter.
  • The Court’s 2013 class action docket, including Mississippi ex rel. Hood v. AU Optronics Corp., Chadbourne & Parke LLP v. Troice, Proskauer Rose LLP v. Troice, and more.
  • Important class action issues that the Court may take up in the next few Terms.
